Section 382 of the Armed Forces Act 2006 (“the 2006 Actâ€) provides that the 2006 Act will expire at the end of one year beginning with the day on which the Armed Forces Act 2016 (“the 2016 Actâ€) was passed, unless continued in force by Order in Council in accordance with that section. The 2016 Act was passed on 12th May 2016. The Armed Forces Act (Continuation) Order 2017 (S.I. 2017/569) and the Armed Forces Act (Continuation) Order 2018 (S.I. 2018/519) each provided for the continuation of the 2006 Act for a period of 12 months. This Order provides for the continuation of the 2006 Act for a further period of 12 months. It provides so that the 2006 Act expires at the end of 11th May 2020.
These Regulations are made in exercise of the powers conferred by the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a), (b), (c) and (g)) arising from the withdrawal of the United Kingdom from the European Union.
These Regulations are made in exercise of the powers in section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a), (d), (e) and (g)) arising from the withdrawal of the United Kingdom from the European Union. Regulation 1(4) to (6) is made in exercise of the power in paragraph 21 of Schedule 7 to that Act.
