These Regulations are made in exercise of the powers in section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) (“EUWAâ€) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(c) of the EUWA) arising from the withdrawal of the United Kingdom from the European Union. The Regulations extend to the whole of the United Kingdom.
These Regulations:modify the effect of retained EU law deriving from certain directly effective rights arising under the Treaty on the Fuctioning of the European Union and the Agreement on the European Economic Area, andamend retained EU law relating to intellectual property,
The provision made by Part 2 of these Regulations is made under section 2(2) of the European Communities Act 1972 (c. 68) in order to update references to Directive 1999/32/EC, which was repealed and replaced (without substantive amendment) by Directive (EU) 2016/802 (O.J. No L 132, 21.05.2016, p. 58), and update an out-of-date reference to the EEA agreement in the Transport and Works Act 1992 (c. 42).

These Regulations amend the Recovery of Costs (Remand to Youth Detention Accommodation) Regulations 2013 (S.I. 2013/507) by inserting a new amount that designated authorities are liable to pay the Secretary of State in respect of each night on which a child is detained on remand in a young offenders institution (increased from £189 to £240), a secure training centre (increased from £546 to £612) and a secure children’s home (increased from £678.70 to £699).

The Public Service (Civil Servants and Others) Pensions Regulations 2014 (S.I. 2014/1964) make provision for the contributions payable by members of that scheme up to 31st March 2019.
