These Rules amend the Civil Procedure Rules 1998 (SI 1998/3132) by—amending rule 45.42(2)(a), which defines an “Aarhus Convention claimâ€, so that the definition includes a statutory review which is within the scope of Article 9(3) of the Aarhus Convention, in addition to a judicial review within the scope of Article 9(3); andsubstituting for Part 53 (defamation claims) a new Part 53 which provides for the Media and Communications List, which is a specialist list in the High Court for defamation claims and other media and communications claims.
These Regulations amend the Transport Act 1968 and the Drivers’ Hours and Tachographs (Amendment etc.) (EU Exit) Regulations 2019 (S.I. 2019/453).
Section 3 of the Transport Act 2000 (c. 38) makes it an offence for a person to provide air traffic services in respect of a managed area without an authorisation to do so by virtue of either an exemption granted under section 4 or a licence granted under section 5. See section 40(3) for the definition of “managed areas†and section 98 setting out the general interpretation of “air traffic servicesâ€.
These Regulations are made in exercise of the powers conferred by the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a) to (d) and (g)) arising from the withdrawal of the United Kingdom (“UKâ€) from the European Union.
These Regulations amend the National Health Service (General Medical Services Contracts) Regulations 2015 (S.I. 2015/1862) (“the GMS Contracts Regulationsâ€) and the National Health Service (Personal Medical Services Agreements) Regulations 2015 (S.I. 2015/1879) (“the PMS Agreements Regulationsâ€) which make provision in respect of the services provided under a general medical services contract and a personal medical services agreement made pursuant to Part 4 of the National Health Service Act 2006 (c.41) (medical services). They apply to England only.
