These Regulations amend the Aggregates Levy (General) Regulations 2002 (S.I. 2002/761). The amendment to the definition of “disposed of to landfill” ensures that a credit remains available for the purposes of Aggregates Levy in respect of landfill disposals in any part of the United Kingdom, but that such disposal must be made at a landfill site that is authorised, licensed or permitted in accordance with environmental legislation.

This instrument amends section 8 of the Employment Rights Act 1996 (c. 18) (“the 1996 Act”), adding to the list of particulars which must be included in the itemised pay statement which an employee has a right to be given. The amendment requires an itemised pay statement to also contain information regarding the number of hours worked by the employee for which they are being paid, but only in situations where the employee’s pay varies as a consequence of the time worked.

These Regulations amend the Ionising Radiation (Medical Exposure) Regulations 2017 (S.I. 2017/1322) (“the 2017 Regulations”). In order to give full effect to the policy intention and to correct errors in the 2017 Regulations, these Regulations come into force immediately after the coming into force of the 2017 Regulations.

The Environmental Permitting (England and Wales) Regulations 2016 (“the principal Regulations”) provide a consolidated regime of environmental permitting in England and Wales. Regulation 2 in these Regulations amends the Discretionary Financial Assistance Regulations 2001 (S.I. 2001/1167), regulation 3 amends the Universal Credit Regulations 2013 (S.I. 2013/376) (the “Universal Credit Regulations”), regulation 4 amends the Jobseeker’s Allowance Regulations 2013 (S.I. 2013/378) (the “Jobseeker’s Allowance Regulations”), regulation 5 amends the Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Decisions and Appeals) Regulations 2013 (S.I. 2013/381) (the “Decisions and Appeals Regulations”), regulation 6 amends the Universal Credit (Transitional Provisions) Regulations 2014 (S.I. 2014/1230) (the “Transitional Regulations”) and regulation 7 amends the Universal Credit (Surpluses and Self-employed Losses) (Digital Service) Amendment Regulations 2015 (S.I. 2015/345) (the “Surplus Amendment Regulations”).

Section 46 of the Health and Social Care Act 2008 (“the 2008 Act”) imposes a duty on the Care Quality Commission (“the CQC”) to conduct reviews and performance assessments of the carrying on by prescribed registered service providers of such regulated activities as may be prescribed and to publish reports of such assessments. These Regulations prescribe the registered service providers and regulated activities for those purposes.

Section 40D of the Immigration Act 2014 makes provision for the court (which in England and Wales means a magistrates’ court) to be able on the application of the Secretary of State (which may be an application without notice) to make a freezing order, which is an order prohibiting any person or body by or for whom an account specified in the order is operated from making withdrawals or payments from the account. The section also makes provision for the court to be able to vary or discharge a freezing order which has been made.

These Regulations amend the provisions governing the making of funeral payments from the Social Fund.

These Regulations, issued free of charge, correct drafting errors in the National Health Service (Quality Accounts) (Amendment) Regulations 2017 (“the 2017 Regulations”), which amended the National Health Service (Quality Accounts) Regulations 2010 (“the 2010 Regulations”). The amendments made by the 2017 Regulations increased the information which has to be included in the quality accounts published annually by NHS service providers. The amendment to regulation 4(2) of the 2010 Regulations taken with the reference to section 8(3) of the Health Act 2009 (“the 2009 Act”) in the opening words of new paragraph (2B), made the new information prescribed information for the purposes of both sections 8(1) and 8(3) of the 2009 Act. This had the effect of imposing the new requirements not only on NHS trusts and foundation trusts but also on other providers of NHS services. This was not the intention, and these Regulations ensure that this information is only prescribed for the purposes of section 8(1) of the 2009 Act, so that the requirements only apply to NHS trusts and foundation trusts (excluding ambulance trusts).

This Order includes new defences relating to preparation errors and dispensing errors by registered pharmacists and registered pharmacy technicians, or persons supervised by them, at retail pharmacy premises. Retail pharmacy premises in the United Kingdom have to be registered by either the General Pharmaceutical Council or the Pharmaceutical Society of Northern Ireland – by virtue of provisions of Part 4 of the Medicines Act 1968. Pharmacy technicians are not statutorily registered in Northern Ireland, and so, as regards Northern Ireland, the new defences only apply to preparation errors and dispensing errors by registered pharmacists and persons supervised by them.
