These Regulations are made in exercise of the powers in section 8 of the European Union (Withdrawal) Act 2018 (c.16) (“the 2018 Actâ€) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under sections 8(2)(a), (b), (d) and (g), and (6)(a)) arising from the withdrawal of the United Kingdom from the European Union.
The Public Service (Civil Servants and Others) Pensions Regulations 2014 (S.I. 2014/1964) established the new Civil Service pension scheme, also known as Alpha, and made provision for the contributions payable by members of that scheme up to 31st March 2020.
Section 1 of the Superannuation Act 1972 (“the Actâ€) permits the Minister for the Civil Service to make schemes which make provision for pension and other benefits in respect of civil servants and persons serving in an office or employment listed in Schedule 1 to the Act. The Principal Civil Service Pension Scheme, the Civil Service Additional Voluntary Contribution Scheme, the Civil Service Compensation Scheme and the Civil Service Injury Benefit Scheme are some of the schemes that have been made under section 1 of the Act.
This Order is made following a review under section 148 (revaluation of earnings factors) of the Social Security Administration Act 1992 (c. 5).
The Insolvency Act 1986 (Prescribed Part) Order 2003/2097 sets out the method of calculation of the prescribed part and is subject to a limit. The prescribed part is the part of the property of a company that a liquidator, administrator or receiver must reserve for unsecured creditors, under section 176A of the Insolvency Act 1986, and which would otherwise be available to satisfy claims secured by a floating charge.
These Regulations amend the Civil Service (Other Crown Servants) Pension Scheme Regulations 2016 (the “2016 Regulationsâ€) (S.I. 2016/326). The 2016 Regulations established a scheme for the payment of pensions and other benefits to civil servants employed by the Secret Intelligence Service and the Security Service. The scheme applies, with appropriate modifications, the rules set out in the Public Service (Civil Servants and Others) Pensions Regulations 2014 (S.I. 2014/1964), which established the Civil Service pension scheme, known as Alpha.
