These Regulations amend the Town and Country Planning (Development Management Procedure) (England) Order 2015 (“the DMP Order 2015â€), the Planning (Listed Building and Conservation Areas) Regulations (“the 1990 Regulationsâ€) and the Town and Country Planning (Environmental Impact Assessment) Regulations 2017 (“the TCP EIA Regulations 2017â€) to enable applications for planning permission, applications for listed building consent, applications for variation or discharge of conditions attached to listed building consent, applications for planning permission affecting the setting of listed buildings or affecting the character and appearance of a conservation area and applications by local planning authorities for listed building consent for the demolition, alteration or extension of a listed building in their area, to be publicised by electronic means during the period when it may be difficult to provide such publication by site display, by service of notice on an adjoining owner or occupier and in newspapers, due to the effect of coronavirus, including restrictions on movement.
These Regulations are made in exercise of the powers conferred by section 8(1) of and paragraph 21 of Schedule 7 to the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a), (b), (d) and (g)) arising from the withdrawal of the United Kingdom from the European Union.
